Please join VALL for our June session, “The Ocean Knows No Borders: Jurisdictional Challenges in Regulating Marine Oil Spills” with guest speaker Stephanie Hewson. Nearly 30 years ago, a national public review panel concluded that a catastrophic oil spill can be expected in Canadian waters once every 15 years. But shipping traffic has increased by more than 300% since then, and will continue to rise, with the risk of spills rising along with it. A series of recent court cases have tested the ability of Canada’s federal laws to effectively manage the risk of marine spills. At the same time, BC is considering draft legislation that may test the limits of provincial jurisdiction over marine oil spills. This presentation will consider the effectiveness of Canada’s legal framework and compare it to examples from other leading jurisdictions.
Stephanie is a staff lawyer with West Coast Environmental Law’s Marine Program, working to strengthen ocean protection locally, provincially and nationally. Her advocacy has contributed to law reform projects on marine oil spills, pollution, coastal management, and marine protected areas. Prior to joining West Coast, Stephanie articled with the Ontario Ministry of the Environment and Climate Change, conducting environmental hearings and prosecutions and contributing to climate legislation. She worked with UBC’s Indigenous Community Legal Clinic in Vancouver, and with an Indigenous council in Alaska to develop a governance strategy for the Yukon River watershed. Stephanie received an undergraduate degree in Arts & Science from McMaster University, and common and civil law degrees from McGill University.
